These Terms of Service ("Terms") govern your use of the Apex Strength Club website at apexstrengthclub.com (the "Site") and, once membership sales and facility access begin, your relationship with Apex Strength Club as a prospective or current member. By using the Site, you agree to these Terms. This is a plain-language summary and not a substitute for the binding Membership Agreement and Waiver of Liability you will sign separately before receiving facility access.
Who We Are
Apex Strength Club is a family-owned strength training and bodybuilding gym located at 4345 Liberty Avenue, Vermilion, OH 44089, opening late Summer 2026.
Use of the Site
The Site is provided for informational purposes: to share information about our facility, membership plans, opening timeline, and to let visitors join our email list or contact us. You agree to use the Site only for lawful purposes and not to interfere with its operation, attempt to access it using automated means beyond normal search engine indexing, or misrepresent your identity when submitting a form.
No Fitness or Medical Advice
Nothing on the Site constitutes medical, health, or fitness advice. Any descriptions of equipment, amenities, or training culture are general information only. Consult a physician before beginning any exercise program, especially if you have a pre-existing health condition.
Memberships and Facility Access
Membership pricing shown on the Site (including Standard, First Responder & Military, and Annual plans) is current as of the last-updated date above and is subject to change without notice until you sign a Membership Agreement. Enrolling as a member, billing terms, cancellation, facility rules, and 24/7 app-based access are governed by the separate Membership Agreement and Waiver of Liability & Assumption of Risk that every member must sign before receiving access credentials. If any statement on this Site conflicts with your signed Membership Agreement, the signed agreement controls.
Intellectual Property
The Site's text, graphics, logos, and photos are owned by Apex Strength Club or its licensors and may not be copied, reproduced, or used commercially without written permission.
Third-Party Links and Services
The Site may link to or use third-party services (for example, our email provider, Vercel hosting/analytics, and, once launched, a payment processor and 24/7 access-control app). We are not responsible for the content, policies, or practices of third-party services.
Disclaimer of Warranties
The Site is provided "as is" without warranties of any kind, express or implied. We do not guarantee the Site will be error-free, uninterrupted, or that our opening timeline, pricing, or amenities described will not change before opening.
Limitation of Liability
To the fullest extent permitted by Ohio law, Apex Strength Club and its owners, employees, and agents are not liable for any indirect, incidental, or consequential damages arising from your use of the Site. This limitation does not apply to injuries occurring at our physical facility, which are addressed separately in the Waiver of Liability & Assumption of Risk that members sign, and nothing here waives liability that cannot be waived under Ohio law (such as liability for gross negligence or willful misconduct).
Governing Law
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Erie County, Ohio.
Changes to These Terms
We may update these Terms as our services expand, particularly once membership sign-ups and facility access go live. Material changes will be reflected by an updated "Last updated" date above.
